Testate
When your loved one dies with a will, only the court will determine if the will is valid. The court will appoint a personal representative who is generally named in the will. During this court procedure, anyone who has a claim against the estate or objects to the will needs to be reached out. This process is long, but we will represent you from the case commencement up to the final distribution of the will assets.
Intestate
Intestate is when your loved one dies without a will. Thus, the property is transferred to their heirs at law. An heir is a close family member designated by statute. In this case, the transfer of the property will conduct in a Probate proceeding. The court will appoint an administrator to handle the estate. This process is long and sometimes very complex, but we will represent you from the commencement of the case to the final distribution of the estate assets.
